Terms and Conditions of Use

The offer and sale of products on our websites (« Elevastor.com » and « Elevastor.fr ») and at our physical store Elevastor located at 1, rue Dupetit-Thouars, 75003 Paris, are governed by the current Terms and Conditions of use.

Products bought on Elevastor.com or at the Elevastor physical store are sold directly by TGS Elevastor, 6, rue de la Ferme, 92200 Neuilly Sur Seine. TGS is registered with the RCS Nanterre, under the VAT number FR26 831156468.

Elevastor sells products on Elevastor.com and at the Elevastor physical store and practices its own e-commerce and physical sale activity directed exclusively toward the final consumer. The “final consumer” is any individual who makes purchases for purposes unrelated to any business or professional activity eventually performed. If you are not a “final consumer,” we ask you to refrain from entering into transactions with Elevastor.com or at the Elevastor physical store. Given the commercial policy described above, Elevastor reserves the right not to respond to purchases made from anyone who is not considered a “final consumer” or any non-compliant orders according to its commercial policy as defined herein.

The terms and conditions of use may be amended, particularly to abide by possible legislative changes. New terms and conditions of use apply to all sales made after their publication on Elevastor.com.

You can view the current version of the terms and conditions of use at any time by clicking on “Terms and Conditions.”

Furthermore, for each order made on Elevastor.com, you will be asked to confirm your agreement to the terms and conditions of use in place during the time that you place your order.

 

Article 1- Price

1.1- The prices of our products are indicated in Euros, all inclusive of tax, excluding processing fees and shipping. These prices may be communicated and converted into ($, £ and ¥).

1.2- For orders outside of metropolitan France, the client is the importer of the products purchased. For all products shipped outside of the European Union and French overseas territories (DOM-TOM), the price will be calculated excluding taxes automatically on the invoice. Customs duties, local taxes, import duties or state taxes may be charged. Elevastor.com is not responsible for paying these taxes and fees. Instead, they are the client’s responsibility, both in terms of declaration and payment to the authorities and powers within the client’s country. Elevastor.com advises that clients inquire about these issues with local authorities in their home country.

1.3- All orders must be paid in euros.

1.4- Elevastor reserves the right to modify prices at any time. However, products will be billed based on the rates in effect at the time the order is made, subject to availability.

 

Article 2- Orders

By validating his or her order online, the client accepts unconditionally and agrees to engage with and respect Elevastor.com’s current terms and conditions of use. If the customer does not agree with the terms specified in the terms and conditions of use, we ask the customer not to place orders on Elevastor.com. By placing an order with Elevastor.com, the client confirms to know and accept our terms and conditions without reservation.

 

Article 3- Availability

Product availability is based on the amount of available stock. Errors may exceptionally exist, especially in the case of simultaneous orders of the same product by several customers. If a product becomes unavailable after confirmation of the customer’s order, we will make every effort to keep the customer informed by email or phone as soon as possible.

When a product is no longer available on Elevastor.com, customers will see a “Sold Out” button appear on the page.

Elevastor.com is not liable in the case of shortage or unavailability of products.

 

Article 4- Order Completion

At any time, the customer can:

Select an article by clicking on “Add to bag”, and then clicking on “checkout”.

Add more items by clicking on “continue shopping”

Consult a list of your selected items by clicking on “your shopping bag”.

The customer may change the quantity of an item he or she wishes to buy by changing the number of units selected, or delete an item by clicking on the “x”.

For each item selected on Elevastor.com, a summary page will appear, showing an image of the product, its color and reference number, the quantity selected, its unit price and the total price of the order. Elevastor.com invites customers to thoroughly check the accuracy of their selection before confirming their order.

Though every effort is made to ensure that the color and pattern of our items are accurately posted on our website, variations may occur, particularly because of computer screen limitations in accurately displaying color. For this reason, Elevastor.com is not liable for inaccuracies in the photographs or graphical representations of products on Elevastor.com.

For questions about products, the customer may contact our customer service team.

Each order made on Elevastor.com requires that the customer provide us with accurate and complete information. The requested information includes: title, name, phone, email address, billing and shipping address.

Once completed, your order will be sent directly for fulfillment.

You may change or cancel your order by contacting Customer Service by email.

Elevastor.com reserves the right not to accept an order from a customer with whom there is a dispute on a previous order, or if Elevastor.com reasonably believes that a client has violated the terms and conditions, or for any other legitimate reason.

If the order do not respect our terms & conditions, the order will be refunded deduce by the payement fees.

A summary of your order will be sent by email. The message will contain the name of the products ordered, the quantity, price and amount of postage.

You may create an account to save the billing and delivery information for your order. You will be asked to create your own password for future use of the account. By doing so, you agree, at your own risk, to keep the password and all other information confidential and never to disclose them to third parties. Accordingly, any purchase made through your account will be assumed to have been made by you. In case of loss, theft or unauthorized use of your account, you agree to relay this information to Elevastor.com immediately.

 

Article 5- Delivery

Items will be sent to the delivery address indicated during the time of purchase. 

If you have chosen the option “Click & Collect,” we ask you to come directly to the Elevastor store, at 1 rue Dupetit-Thouars, 75003 Paris from Tuesday to Saturday between 11:00 am and 7:30 pm and on Sunday from 12:00 pm to 7:00 pm. Please bring a copy of your bill and a valid personal ID.

You can pick up an order as soon as you received a notification by email.

The deadline to pick up a “Click & Collect” order is 1 month after purchase. 

Shipping fees are calculated automatically, just after you have finalized your order. They will appear in the amount you must pay. The amount depends on the products ordered, delivery area and the selected service. 

When sending a package, we will send an email with the tracking number. You can follow your order from dispatch until arrival on the website of the delivery service by indicating the tracking number.

 Customs and other fees incurred in the destination country are the responsibility of the recipient.

Any defect or delay in delivery exceeding 8 working days must be reported to our Customer Service by email or telephone.

You must check the conformity of the goods at the time of delivery and indicate, if possible, on the delivery note, in the form of handwritten reserves accompanied by your signature any anomalies found (open package, damaged product, ...)

You must then contact the Customer Service by email (contact@elevastor.com).

 Article 6- Payment

You may choose between the following payment methods:

  • Credit card
  • Paypal (not allowed for “Click & Collect” orders)
  • Apple Pay

For payment using a credit card, we accept: Visa, MasterCard, Amex or Maestro.

 

Article 7- Returns and Exchanges

Elevastor is committed to providing you with high quality items. However, if you are not satisfied with an item you have purchased with us, we will be happy to exchange or refund you. You have 14 days from the date of receipt of the item when it is purchased through our website Elevastor.com ; or from the date of purchase if bought at the Elevastor store, to return it to Elevastor.

Items must be returned in their original condition, in their packaging and with a copy of the invoice to the following address:

We will provide you with a return shipping label by email and return costs will be deducted from your refund

 

 Customs taxes applying from countries outside the European Union may be charged to the customer if the return is proceeded with his/her own courier.

If you want to keep the amount for a future purchase, a credit note can be issued to you.

  • Damaged or incomplete items will not be accepted and will be returned to you at your expense.
  • Packages returned without necessary return information will be sent back to the customer.
  • Perfumes and beauty products will not be exchanged or refunded.
  • Marked down items cannot be exchanged or reimbursed.
  • Electronic items that have been opened cannot be exchanged or returned.
  • Music downloads are not reimbursable.
  • Art pieces and furniture followed specific conditions.

Article 9- Intellectual Property

All text, commentary, articles, illustrations and images produced on the Elevastor.com website are all rights reserved. As such, in accordance with the Intellectual Property Code, only private use is tolerated.

Any other use constitutes infringement and is punishable under Intellectual Property laws unless Elevastor gives permission before use.

Total or partial reproduction of the Elevastor.com catalog is strictly prohibited. All rights reserved.

 

Article 10- Responsibility

All items offered by Elevastor comply with French legislation. It is your responsibility to check with local authorities in your country to verify the possibility of delivery within your country and the use of the products you plan to order.

 

Article 11- Applicable Law- Disputes

In the case of a legal dispute, the French courts have jurisdiction.

 

Article 12- Personal Information

Elevastor agrees not to disclose any information provided to us to third parties. This information remains confidential and will only be used by our internal departments to process your order, to personalize communication, or to offer specific products, including the Elevastor newsletter which subscribes customers based on areas of interest.

Consequently, and in accordance with the Data Protection Act of January 6, 1978 (declaration number 1733208 v 0), you have the right to access, rectify and oppose to any personal data registered about you. To do this, simply send a request by email to: contact@elevastor.com with your name, surname, address, e-mail and if possible client number.

 

Article 13- Downloads

Prior to finishing the order, the customer must ensure that he or she has the necessary software to read various files, is able to download the files, and has the appropriate Internet connection.

Upon payment confirmation, the customer will automatically receive the audio files on his or her computer.

Refund and withdrawal:

Like for all downloaded purchases, no refund of any kind will be made after the confirmation of payment of the order.

Return requests made by customers who have changed their mind before they have started to listen will not be considered, as it is impossible for Elevastor to know whether a person has or has not downloaded the content of the order.

If the customer has not received the email with the download links, he or she may send a message within 6 months to Elevastor customer service at: contact@elevastor.com.

We advise customers to backup all downloaded files to make sure that they do not accidentally delete them.
